These Terms of Use govern your use of the Halloween Filter iPhone app. By using the app, and by accepting these terms during Sign in with Apple, you agree to them.
1. The service
You submit a photo, choose a Halloween effect and ask us to generate a stylised portrait. The app lets you view, save and share a completed result. AI generation is probabilistic: results can vary, may contain errors and are not guaranteed to meet a particular expectation.
2. Age and eligibility
You must be at least 18 years old to use Halloween Filter. The service is not directed to children, and you must not submit a photograph of a minor.
3. Your photo and your rights
You keep your rights in the photo you submit. You give us a limited permission to store, transmit and process it only as needed to provide, secure and operate the service.
You confirm that the photo is of you, or of another adult who has agreed to the photo being submitted and transformed. You must have the right to use every image you submit.
4. Acceptable use
You must not use Halloween Filter to:
- submit a photo of another person without their informed agreement;
- submit a photo of a minor;
- create or share unlawful, abusive, deceptive, harassing or infringing content;
- impersonate someone, misrepresent an AI portrait as a real photograph, or use a result as evidence;
- probe, disrupt, reverse engineer or misuse the app or service; or
- circumvent safety, account, payment or render limits.
Our AI provider may refuse images or requests for safety reasons. If a render fails, the credit charged for that render is automatically returned.
5. Renders and payment
Halloween Filter sells consumable render packs through Apple’s App Store. They are not subscriptions. Render credits have no cash value, cannot be transferred and do not expire while the service and your account remain available.
Prices and taxes are shown by Apple before purchase. Apple processes payment. Sign in with Apple and acceptance of the current Terms and Privacy Policy are required before buying a pack.
6. Refunds
Apple controls App Store refunds. We cannot approve or pay an App Store refund ourselves. Request one through Apple’s refund process.
If Apple grants a refund, the related render credits are reversed. Your balance may become negative if those credits were already used. You can object to future refund-consumption reporting by contacting admin@singmehappybirthday.com.
7. AI processing and third parties
All Halloween Filter image generation uses Google Gemini. We send the photo and the selected effect instructions to a Google Gemini image model to generate the result. For details about storage, processing and your choices, read our Privacy Policy and Google’s Gemini API Additional Terms.
8. Intellectual property and sharing
You may save and share your generated portrait for personal, lawful purposes. You are responsible for how you use and share it. We do not promise that a generated result will be unique; AI systems can produce similar results for different people.
9. Independent entertainment app
Halloween Filter is an independent entertainment app. The portraits are AI-generated for fun and are not real photographs. The app is not affiliated with, endorsed by, or connected to any film studio, franchise, or character. Any resemblance to specific copyrighted characters is unintentional.
10. Availability and liability
We aim to keep the service available but do not promise uninterrupted or error-free access. We may change, suspend or discontinue effects or service features where reasonably necessary.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights. Subject to that, Halloween Filter is not responsible for indirect or unforeseeable losses, or losses caused by misuse of the app. Our total liability connected with a paid purchase will not exceed the amount you paid for the affected purchase.
11. Ending use
You may stop using the app at any time. You can delete individual renders from Gallery. Signing out does not delete your account or server-side information. To request account deletion, contact admin@singmehappybirthday.com.
12. Governing law and changes
These terms are governed by the law of England and Wales. If you are a consumer, you keep any mandatory protections and rights to bring a claim available where you live.
We may update these terms when the service or law changes. Material changes will use a new terms version and may require you to accept the updated terms before continuing.
